HB2320 (Chapter 44) (HD1647) - An Act relative to the position of treasurer-collector in the town of Berkley

Summary:
Creates an appointed treasurer-collector position in the Town of Berkley, merging the previously elected roles of treasurer and collector into one. The treasurer-collector will assume all powers, duties, responsibilities, and liabilities previously held by the separate offices. The board of selectmen will appoint the treasurer-collector and have authority to remove the officeholder; the board can also set up an employment contract lasting up to three years, contingent on annual budget approvals, which will outline salary, benefits, expenses, and performance criteria. Once enacted, this bill will terminate the current elected positions of treasurer and collector, but incumbents may continue until their terms expire or until the new treasurer-collector is appointed, based on which occurs first. The transition to the appointed office will not affect any existing contracts or liabilities of the former positions. Additionally, all records, property, and equipment belonging to the elected treasurer and collector offices will be transferred to the new treasurer-collector. Summary:
Adds new section 20S to GL 276 to provide that any employee of the Commonwealth considered a court officer, or or any state, county or local law enforcement officer shall comply with a written detainer request by U.S. Immigration and Customs Enforcement requesting detention of an individual on the grounds that there is probable cause that such person is a removable alien; requires that such person be provided with a copy of the request; provides that no period of detention shall exceed 36 hours; adds new section 104 to GL 276 providing that a Judicial Officer presiding over a bail hearing of the individual shall consider the existence of an Immigrations and Customs Enforcement Detainer request.
